QuicKutz Wins Summary Judgement: Court Rules Against Spellbinders in Patent Infringement Lawsuit

OREM, Utah – November 13, 2012 Lifestyle Crafts (Orem, UT), a recognized leader in the crafting industry and home of QuicKutz dies, announced today that the United States District Court for the District of Arizona has granted summary judgement in favor of QuicKutz in the patent infringement lawsuit filed against QuicKutz by Spellbinders Paper Arts Company (Phoenix, AZ). Court rulings found the Spellbinders '634 patent “unenforceable due to inequitable conduct” and granted QuicKutz's motion for summary judgement. This ruling ends the lawsuit between the two companies.

Chief Judge Neil V. Wake issued a detailed order stating that Spellbinders and its CEO, James Jeffrey Caron, were found by the court to have engaged in numerous “affirmative act[s] of egregious misconduct” before the Patent and Trademark Office.

The Court order also stated that it “finds by clear and convincing evidence Plaintiffs [James Jeffrey Caron and Spellbinders Paper Arts Company] acted with the specific intent to deceive the PTO.” Both were also found to have engaged in a “pattern of deception and discovery abuse [before the Court that] make it impossible to conduct a trial with any reasonable assurance that the truth will be available.”
